Terms of Use
Effective and last updated: October 29, 2026
The rules for using Pickentra, including account responsibilities, AI limitations, monthly billing, cancellation, and refunds.
Pickentra is operated by HCP Automation LLC dba HSP Automation. Questions? Contact info@pickentra.com.
1. Agreement and eligibility
These Terms of Use are an agreement between you and HCP Automation LLC dba HSP Automation (“Pickentra,” “we,” “us,” or “our”) governing the Pickentra website and services. By creating an account, purchasing a plan, or using the service after being presented with these Terms, you agree to them. If you do not agree, do not create an account or use the service.
You must be at least 18 and able to enter a binding agreement. If you act for a business or other organization, you represent that you have authority to bind it; “you” then includes that organization. Pickentra is intended for business use. Mandatory rights under applicable law remain unaffected.
2. What Pickentra provides
Pickentra helps businesses understand how they appear in AI-generated answers to approved local buyer questions. Features may include customer-authorized website review, business-profile confirmation, scans, evidence, scores, competitor comparisons, recommendations, and report delivery. The plan and enabled features determine what you receive.
Alpha and beta access may require manual approval and configuration. Features, schedules, and availability may change during testing. A public sample report contains illustrative data, not a live report about your business. A demonstration or sandbox checkout is not a live purchase. Charges apply only when you agree to a paid plan through enabled checkout or another express purchase agreement.
3. Accounts and authorized use
Provide accurate information, keep your credentials confidential, and maintain appropriate access for your account members. You are responsible for activity you authorize and must promptly report suspected unauthorized access. Submit a website for review only if you have authority to request that review. You must be entitled to provide the business information and other material you submit. Customer attestation is not independent verification of website ownership. You may not impersonate another person or business or evade account restrictions.
4. AI limitations and no outcome guarantees
AI-generated answers can be incomplete, inaccurate, inconsistent, or outdated. Rankings, mentions, citations, scores, and recommendations are observations from particular questions, providers, models, settings, and times. They are not a measurement of every real customer interaction or every AI or search service. Different versions may not be directly comparable. A missing mention does not prove that customers never see your business.
We do not guarantee placement, improved scores, recommendations by an AI system, traffic, leads, revenue, or any other business outcome. We do not control third-party AI systems, search engines, or cited websites. Review evidence and use your own judgment before acting on a report. The service does not provide legal, financial, or other regulated professional advice.
5. Prices, payment, and monthly renewal
Your price, currency, billing interval, and any expressly offered trial or discount are shown before purchase. Unless the purchase terms state otherwise, a monthly subscription renews automatically each month until canceled. You authorize the payment provider to collect the agreed recurring charges and applicable taxes. Keep your billing information current. No free trial or promotional benefit is promised unless expressly offered to you.
We use Stripe to process payments. Its applicable terms also govern its payment services. Past-due or failed payments may pause new scans immediately; there is no guaranteed grace period. We will give notice of price changes where required, and any change to a recurring plan applies prospectively rather than changing an already-paid period.
6. Cancellation and refunds
You may cancel a monthly plan at any time. Cancellation takes effect at the next scheduled renewal date, at the end of your current paid billing period—not immediately. A cancellation recorded before renewal prevents the next renewal charge. Subject to these Terms, your paid access continues through the current period.
Use the subscription controls available from Billing. If you cannot access those controls, contact info@pickentra.com before your renewal date to request cancellation. Simply stopping use of Pickentra does not cancel a subscription.
No refunds are given once an AI scan has been performed, because the service has been received. No partial or prorated refunds are provided. This includes unused days or scans and cancellation partway through a billing period. Contact us about billing errors or refund questions, including a request made before an AI scan has been performed. These Terms do not limit refunds, cancellation rights, or remedies that applicable law requires.
If a refund is otherwise available, and only where applicable law permits, we may deduct documented, nonrecoverable third-party AI processing costs actually incurred for scans you authorized, covered by the charge being refunded, and performed before we received the relevant cancellation or refund request. We will itemize any deduction and will not add a markup, administrative fee, or cancellation penalty. Any deduction is limited to the amount the law permits and requires any prior disclosure or consent that applicable law requires. If those requirements were not met, no deduction will be made. We will not deduct AI costs from a refund that applicable law requires us to pay in full.
Cancellation or past-due billing does not itself delete existing reports. Existing reports remain readable unless the account is suspended for abuse, subject to lawful deletion requests and applicable retention requirements. New scans require the applicable active entitlement.
7. Your information and report use
You retain rights you have in information you submit. You give us a limited license to host, process, reproduce, and transmit it as reasonably needed to operate and support Pickentra, including authorized processing by our service providers. Our Privacy Policyexplains personal-information handling. This license does not give us ownership of your business or permission to sell your private account data.
You may use and share your reports for lawful business purposes, subject to these Terms and third-party rights. AI output may not be unique and may contain third-party material; we do not promise exclusive intellectual property rights in it. Do not represent a report as an endorsement by an AI provider or misstate what its evidence shows.
8. Acceptable use and intellectual property
Do not use Pickentra unlawfully, infringe others’ rights, submit malicious material, harass others, misuse personal information, interfere with the service, bypass access controls or usage limits, conduct unauthorized security testing, or use automation that disrupts the service. Do not attempt to access another customer’s private information or use the crawler to obtain restricted or non-public content.
We and our licensors retain rights in Pickentra’s software, design, branding, and methodology, excluding your information and third-party content. You receive a limited right to use the service under these Terms, not ownership of the software. You may not resell the service, remove proprietary notices, or copy protected components except as authorized or permitted by law.
9. Suspension, termination, and service changes
We may restrict or suspend access for nonpayment, abuse, security risks, legal requirements, or a material breach of these Terms. Where reasonably practical and appropriate, we will provide notice and an opportunity to address the issue; urgent protective action may be immediate. Contact us to ask for review of a suspension or other account decision.
You may stop using the service and request account closure. Cancel paid subscriptions separately as described above. Closing an account or ending access does not erase amounts already owed or override our Privacy Policy’s retention provisions. We may change or discontinue features, subject to applicable law and any express purchase commitments. No minimum uptime or service-level commitment applies unless separately agreed in writing.
10. Disclaimers
To the fullest extent permitted by law, Pickentra is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. Third-party services and public sources may be unavailable or change without our control. Nothing in these Terms excludes a warranty or protection that cannot legally be excluded.
11. Limits of liability
To the fullest extent permitted by law, neither we nor our suppliers are liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, business opportunities, goodwill, or data arising from use of or inability to use Pickentra. Our total aggregate liability arising out of the service or these Terms will not exceed the fees you paid us for Pickentra in the 12 months before the event giving rise to the claim. These limits do not apply to liability that applicable law prohibits us from excluding or limiting, and do not restrict mandatory statutory remedies.
12. Idaho law and dispute resolution
These Terms are governed by the laws of the State of Idaho, United States of America, without regard to conflict-of-law principles. Please contact us first so we can try to resolve a concern informally; doing so does not waive legal rights or prevent urgent relief. Unless mandatory law requires otherwise, disputes will be brought in state or federal courts located in Idaho, and the parties consent to their jurisdiction. These Terms do not impose mandatory arbitration or waive rights that cannot lawfully be waived.
13. Changes, general provisions, and contact
We may update these Terms and will change the date above. We will provide notice of material changes and seek consent when required by applicable law. Changes apply prospectively. If you do not accept a material change, stop using the affected service and cancel your subscription before its next renewal.
These Terms and any expressly agreed purchase terms form the agreement about Pickentra. A provision found unenforceable will be limited or removed only as necessary; the rest remains effective. Failure to enforce a provision is not a waiver. Provisions that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, and applicable liability limits, will survive.
